Subrogation Claim

Toronto teacher Mike Stewart is slowly taking his first steps after being critically injured in a bizarre incident earlier this year.

One night in mid-March, an egg was thrown at the front window of his home in Rexdale. As his wife Trina cleaned it up, he went outside to see if the culprit was still around and saw a van driving away. He claims the van then turned around and jumped the curb to deliberately hit him.

The accident crushed one of his vertebrae and has forced him to relearn how to walk. Police are still investigating a number of leads, including analysis of paint chips from the “attacking” vehicle. Mike and his wife have no idea who could have targeted them in such a violent – and cowardly – way.

No matter how they happen, automobile accidents can have devastating effects on your health and ability to earn a living. In Mike Stewart’s case, they have yet to find the owner of the van that struck him, but when they do it will be up to his lawyers to obtain sufficient damages to compensate him for his considerable losses.

Settlements & Subrogation

There are a number of factors to take into account when coming up with a figure for the settlement; among them is the issue of subrogation. In Mike’s case – as in so many – OHIP has rightfully paid for his medical care. However, that agency also has the legal right to recover some or all of those costs from any insurance settlement he may receive. That’s the principle known as subrogation.

How We Can Help

Here at Petrillo Law, we approach these cases comprehensively, keeping the issue of subrogation in mind. That means that we’ll advise you of the “true cost” of your personal injury claim. We’ll make sure the subrogated claim amount is already included in the damages we seek on your behalf, so you won’t be left short when OHIP comes to get their share.
