An Ontario man is filing suit in the United States over a slip and fall accident he suffered while on vacation in North Dakota. He fell 4 feet from a sidewalk onto a parking lot. His claims list the fact that there was no guard rail and inadequate lighting outside the hotel where it occurred.
The hotel management company has countered by insisting that the conditions of the sidewalk were “open and obvious” and any injuries are the result of his own negligence. It’s a typical situation on the face of it.
