West of Toronto, the city of Windsor is taking a proactive approach to avoiding slip and fall lawsuits by repairing and replacing sidewalks now – before they become an issue. In 2011, the city of just over 200,000 people was hit with a slew of lawsuits and paid just under $300K to fight them with insurance covering another $132K for the damages awarded.
The city is taking action where sidewalks sport cracks of over 2cm. Slip and fall lawsuits are the most common type faced by the city and it makes good financial sense to take this approach. In Ontario, if the municipality is at least partly to blame, an injured party can collect all the costs associated with the injury from city coffers.
