An Ontario water park is under fire after news of recent lawsuits hit the press – including a slip and fall injury.
Any business has the inherent duty of protecting the safety of its customers. When it comes to slip and fall injuries, for example, it means:
- Shops need to keep walkways clear of snow and ice
- Stores and other businesses open to the public need to make sure unravelling carpeting or missing floor tiles don’t present a hazard
When the business itself has some level of inherent risk – such as a waterpark or other amusement park where people engage in very active behaviour that already carries a certain risk of injury – that responsibility is taken even more seriously in the eyes of the law.
A woman is suing the waterpark for $1.75 million for a slip and fall injury that occurred on one of the rides in 2012. In a statement, the company insists that “our infrastructure is state-of-the-art and of the highest quality and design; all of our slides and structures undergo rigid safety inspections.” They also claim that the slip and fall occurred after she’d gotten off the ride and that the injury only involved a scrape to the victim’s back.
“Just” a Slip and Fall
Attempting to be dismissive of and downplay the results of a slip and fall injury are common tactics used by defendants in these cases. After all, people slip and fall every day and then just get up and keep going, don’t they? The implication is that the accident victim is a money-hungry cheater who just wants to cash in on a good company or business’ reputation and earnings.
We know differently. We understand that slip and fall accidents can result in a number of different kinds of injuries, including:
- Broken bones
- Soft tissue injuries (like sprains)
Often, it’s not the initial injury that is the most problematic, but rather the residual effects, such as:
- Arthritis
- Carpal Tunnel Syndrome
- Degenerative disc disease
- Chronic back pain
- Spinal stenosis
That’s why it’s important to get medical attention right away even if your injuries seem relatively minor.
The second thing you need to do is to contact a slip and fall lawyer immediately. It’s the only way you can fully protect your interests and try to get the compensation you need to start on the road to recovery and rehabilitation.
