A recent motor vehicle accident in Toronto began with a dispute about taxi fare and ended in tragedy.
After arguing with a taxi driver about his fare, a man apparently stole the taxi cab and went on an ill-advised joy ride through the city. He ran a red light and caused a three-vehicle car accident that left an older man dead and his daughter critically injured.
He’s facing 13 charges, including dangerous operation of a motor vehicle, criminal negligence, impaired driving, theft and fraud among others. The accident happened at Royal York Road and Lawrence Avenue West during rush hour on a Monday morning.
What About No Fault Insurance?
It’s true that car insurance in the province of Ontario operates under a “no-fault” system. This means that if you are injured in a car accident or motor vehicle accident (i.e. involving a bus, truck, motorcycle or van,) you can claim benefits for lost wages and out of pocket medical expenses from your own insurance provider. In theory at least, that simplifies matters and speeds things up for you as an accident victim – i.e. you don’t have to wait for an often lengthy court proceeding.
However, your own insurance benefits are limited and in egregious cases like this, where injuries are deemed to be “serious and permanent”, you do have the right to sue the driver responsible for the accident directly.
What’s The Best Choice?
In the case of a truly horrific accident like this one, as the surviving victim or their family member, you will naturally be confused and distraught, and first concerned with your physical recovery. The ins and outs of the law and your auto insurance policy are complex and depend on many factors. What’s your best choice?
