A Saskatchewan judge recently gave a rebuke to all insurance companies who routinely refuse to pay legitimate claims or cause unnecessary hardship to their claimants
He awarded a cool $4.95 million – of which $4.5 million was punitive damages – with a message to all Canadian insurers.
The case involved a Canadian who was working in Krygyzstan when he was involved in a work accident. An injury to his foot became aggravated and doctors told him it was untreatable. He filed a suit against two insurance companies after failing to get a satisfactory offer. The judge accused the companies of flat out refusing to pay benefits owed and delaying tactics he described as ‘malicious’.
The odds aren’t even when you deal with an insurance company that has millions of dollars in resources when it comes to legal advice. Add to that a penchant for underhanded tactics and you have recipe for disaster.
